You must ask not only who the owner is, but also whether a lien or mortgage note is required, which is one of the barriers to registration. The deed may be valid and the owner appears in the real estate records. But the property is burdened with a foreclosure or foreclosure sign that prevents the sale.<\/p>\n<p>Seizing on real estate means the presence of a legal restriction placed on the real estate registry due to a lawsuit, debt, or judicial or executive procedure. This restriction means that the freedom to dispose of the property has become restricted. It is not permissible to treat it as a property free of obstacles before knowing the reason for the seizure, the party that placed it, and the method of lifting it<br \/>\nIn the Iraqi Real Estate Registration Law, registration barriers are legal restrictions that prevent the registration from being carried out, including the seizure of the property by a legally authorized judicial or official authority. Rather, it is often a guarantee of a debt. That is, the owner remains the owner of the property, but the property is a guarantor of the creditor&#8217;s debt. If the debtor does not pay the debt, the mortgage creditor may have the right to take precedence over others in collecting his right from the price of the property. The Iraqi Civil Law defines the security mortgage as a contract that grants the creditor a real right over a property allocated to satisfy his debt that allows him to take precedence over ordinary creditors and those next to him in rank.<br \/>\nThe difference between seizure and mortgage is that seizure is often linked to a judicial or executive procedure to prevent disposition or guarantee a right subject to a claim. As for the mortgage, it is usually created by an agreement between the property owner and the creditor to guarantee a specific debt. Therefore, you may see in the real estate registry a reference to a seizure due to a lawsuit or enforcement. You may see a security mortgage to a bank, creditor, or financing body.<br \/>\nIn principle, the mortgager may dispose of the mortgaged property by selling or otherwise as a security mortgage. However, this action does not affect the right of the mortgage creditor. This means that the buyer may purchase a property and the mortgagee\u2019s right remains valid if the mortgage is not legally addressed before purchase or during registration.<br \/>\nSeizing the property requires a legal document and conditions. The Federal Court of Cassation decided that a request for precautionary seizure loses its legal basis when the conditions for seizure specified in Article 231 of the Civil Procedure Code are not met. This shows that the presence of a reservation signal does not always mean that the road is blocked. But it means that the matter requires a legal examination before making a purchase, appeal, or requesting a removal. \ufffc<br \/>\nAs for the original residence, it requires precise detail according to the type of debt, the status of the debtor, and the property. It is stated in one of the principles of the judiciary that the residence may not be seized and sold if the debtor does not own another and the debt does not arise from its price or it is not mortgaged. Therefore, it is not correct to give a general answer without reading the document, the reason for the debt, and the executive procedures<br \/>\nThe bottom line is that the seizure and mortgage of real estate in Iraq is not just an administrative observation. They may even change the fate of the entire sale. A secure property is a property whose freedom from restrictions is proven in the real estate registry. Any purchase before this examination may turn the dream of ownership into a long lawsuit before the courts.
