First: The Protection of the Right to Life and the Integrity of the Human Person.<\/strong><\/span><\/p>\n The Iraqi legislator has been keen to safeguard human life and bodily integrity, considering any assault thereon among the gravest of crimes. Article (405)<\/span> of the Iraqi Penal Code No. 111 of 1969<\/span> prescribes punishment of life imprisonment or temporary imprisonment for those who commit the offence of intentional homicid, The law likewise imposes penalties for assaults upon bodily integrity, such as battery or injury, thereby ensuring the protection of the individual against any physical violation to which he may be subjected.<\/p>\n Second: The Protection of Property and Assets.<\/strong><\/span><\/p>\n The law likewise affords protection to the property and assets of individuals against unlawful interference, Article (439)<\/span> of the Iraqi Penal Code prescribes punishment for the commission of theft, recognising it as an infringement upon the ownership rights of others The law further criminalises acts of fraud, breach of trust, and other offences that impinge upon the financial rights of individuals.<\/p>\n Third: The Protection of Civil Rights and Transactions between Individuals.<\/strong><\/span><\/p>\n The Iraqi Civil Code No. 40 of 1951<\/span> regulates financial and contractual relations between individuals and affirms the principle of respect for contractual obligations.<\/p>\n Fourth: The Protection of the Family and Social Rights.<\/strong><\/span><\/p>\n The Iraqi legislator accorded special attention to the family through the Personal Status Law No. 188 of 1959<\/span>, which regulates matters of marriage, divorce, maintenance, and custody.<\/p>\n Fifth: The Guarantee of the Right to Litigation.<\/strong><\/span><\/p>\n The right of recourse to the judiciary constitutes one of the most fundamental legal guarantees safeguarding individuals, Article 19(Third)<\/span> of the Iraqi Constitution of 2005<\/span> stipulates that litigation is an inviolable and guaranteed right for all.
