Such searches are conducted pursuant to a written judicial order, and the search constitutes lawful evidence provided that it is undertaken in accordance with procedural rules.<\/strong><\/p>\n<p><strong>By its very nature, it is a measure that interferes with privacy and private life, lying at the intersection between freedom of expression and the protection of state security and the safety of citizens.<\/strong><\/p>\n<p><strong>Investigating judges and investigators apply flexible traditional provisions to adapt electronic crimes (such as defamation and extortion) under the Penal Code, relying on provisions mandating expert appointment to secure digital evidence, due to the absence of a comprehensive special law on cybercrimes to date.<\/strong><\/p>\n<p><strong>The officer conducting the search shall draw up a record specifying the time and place of the search and the physical evidence seized, in the presence of the accused or the owner of the inspected device.<\/strong><\/p>\n<p><strong>In the end, this law is applied in accordance with the applicable Iraqi Penal Code and the Code of Criminal Procedure, under Articles <span style=\"color: #253b9c;\">78, 79, and 84(A)<\/span>.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Electronic search:- is a criminal investigative procedure carried out by the competent authorities (the investigating judge or the investigator) through access to smart devices, such as electronic accounts and data, for the purpose of seizing evidence of cybercrimes, blackmail, and conventional offences committed via the internet.
